Welcome to Nuvirtis. These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you, the user of this website, and Nuvirtis, a provider of virtual diagnostic assessments and related services (hereinafter referred to as “Nuvirtis,” “we,” “us,” or “our”). By accessing, using, or engaging with any part of our website (the “Site”), including but not limited to browsing the Site, submitting information, or purchasing services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.
If you do not agree to these Terms in their entirety, you are expressly prohibited from using the Site and must cease use immediately. Your continued use of the Site signifies your acceptance of any amendments or updates to these Terms, which Nuvirtis reserves the right to modify at any time at its sole discretion. Any modifications will be effective upon posting on the Site, and it is your responsibility to review these Terms regularly.
Article 1: Service Descriptions
Nuvirtis provides mental health coordination services through virtual assessments conducted between 9:00 AM and 7:00 PM, seven days a week. These assessments enable us to connect clients with appropriate mental health professionals & clinicians based on individual requirements and clinical needs. Our coordination decisions rely exclusively on information provided by clients during initial telephone consultations. We do not undertake independent verification of client information, and clients bear responsibility for ensuring all relevant details are disclosed during the assessment process.
Nuvirtis maintains discretion regarding client acceptance and may decline services without providing justification. Should circumstances warrant service discontinuation after initial acceptance, we reserve the right to terminate coordination services. When appropriate, we will facilitate referrals to alternative providers or recommend consultation with primary care physicians.
Article 2: Client Obligations
Clients must provide accurate and comprehensive information to Nuvirtis personnel and referred healthcare providers throughout the coordination process. Clients shall promptly notify Nuvirtis of any changes in their mental health status that may impact treatment safety or appropriateness. All client communications must maintain professional standards. Nuvirtis does not tolerate abusive, threatening, or inappropriately aggressive behavior toward staff members. Violations may result in immediate service termination without financial restitution. This policy does not preclude legitimate complaints filed through appropriate channels.
Service concerns should initially be addressed with assigned coordination staff. Formal complaint procedures are available upon request when initial resolution attempts prove unsuccessful. Clients must provide timely notification for appointment modifications or cancellations as specified in these terms.
Article 3: Emergency Protocols
Nuvirtis does not provide emergency mental health services or after-hours crisis intervention. During operational hours, urgent matters should be directed to Nuvirtis for non-critical concerns or to emergency services for immediate threats. Outside operational hours, clients must contact emergency services, crisis mental health teams, or primary care providers directly.
When assessments indicate requirements for specialized care beyond Nuvirtis coordination capabilities, appropriate external referrals will be arranged.
Article 4: Financial Policies
Current service fees are communicated at the time of appointment scheduling and may be amended periodically with appropriate notice.
Initial appointment fees must be remitted within 48 hours of booking to confirm scheduling. Failure to meet this requirement will result in automatic appointment cancellation. Subsequent appointment fees are due 48 hours prior to scheduled sessions, with non-payment potentially resulting in cancellation or reallocation. When payment is arranged by parties other than the client (including family members, or insurance providers), such parties must comply with all terms herein, including cancellation fee provisions.

Article 5: Appointment Modifications/Cancellation Policy
A minimum of 48 hours' notice is required to cancel or reschedule an appointment. If you fail to provide at least 48 hours’ notice, a cancellation fee equivalent to 25% of the total assessment fee will apply. Cancellations made with less than 24 hours’ notice or failure to attend an appointment will result in a charge of 50% of the total assessment fee.
For appointments scheduled on a Monday, cancellation or rescheduling notice must be given no later than 12:00 p.m. on the preceding Thursday. If you reschedule more than twice, Nuvirtis reserves the right to withdraw the service and terminate the agreement without refund.
Article 6: Healthcare Provider/GP Coordination
Nuvirtis strongly recommends maintaining communication with primary care physicians regarding mental health treatment arranged through our coordination services. This communication ensures comprehensive care coordination and supports optimal treatment outcomes.
Referred providers may require primary care physician notification before prescribing medications. This requirement serves patient safety interests and helps prevent adverse drug interactions.
Clients seeking private assessments with subsequent transition to HSE care should confirm primary care physician cooperation in advance. Nuvirtis cannot guarantee HSE provider acceptance of privately obtained assessments and may recommend continued private care when HSE options are unavailable.
Article 7: Privacy and Data Protection
Personal information handling complies with applicable data protection legislation, including the General Data Protection Regulation (GDPR). Data usage is limited to coordination service provision, with comprehensive privacy policies available on our website.
Legal requirements may necessitate information disclosure in specific situations, including risks of serious harm, child protection concerns, terrorism-related matters, or other legally mandated reporting. Service acceptance constitutes acknowledgment of these potential disclosure requirements.
Article 8: Minor Client Considerations
When providing coordination services for minors with sufficient maturity to make treatment decisions independently (following Gillick competency principles), Nuvirtis must respect such decisions, including treatment refusal or confidentiality requests. Legal obligations in these circumstances may supersede family preferences.
Article 9: Liability and Limitations
Nuvirtis functions as a coordination service exclusively. Treatment relationships exist directly between clients and referred providers. Nuvirtis accepts no liability for treatment outcomes, provider decisions, or clinical care quality. Nuvirtis liability for service failures is excluded when such failures result from client non-compliance with these terms.
Except for death or personal injury resulting from Nuvirtis negligence, total liability for all claims shall not exceed fees paid by the client during the twelve months preceding the claim. All consequential and indirect damages are excluded to the maximum extent permitted by law.
To the fullest extent permitted by law, Nuvirtis, its directors, officers, employees, agents, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising out of or related to your use of, or inability to use, the Site or services provided by Nuvirtis.
Further, Nuvirtis is not liable for the actions, omissions, or negligence of any third-party service providers affiliated with or accessible through the Site. The services provided by independent contractors, such as medical consultations or other expert services, are beyond Nuvirtis’ scope of control and Nuvirtis expressly disclaims any responsibility for such services.
Article 10: Third-Party Payers
Individuals or entities making payments on behalf of clients agree to be bound by all provisions of these terms, including financial obligations and cancellation policies.
Article 11: General Provisions
These terms constitute the complete agreement between Nuvirtis and clients regarding coordination services. Nuvirtis shall not be liable for performance delays or failures resulting from circumstances beyond reasonable control, including but not limited to natural disasters, government actions, or other force majeure events. Terms may only be modified through written notice from Nuvirtis delivered via electronic communication. Clients cannot unilaterally alter these provisions. All fees must be paid without deduction or offset except as legally required. These terms are governed by and construed in accordance with Irish law.
